Namnlagen

The Swedish Names Act (namnlagen) is the primary legislation governing the registration, use, and change of personal names in Sweden, currently regulated under the Names Act 2016 (lag 2016:1013 om personnamn).

Sweden's current Names Act came into force on 1 July 2017, replacing the 1982 Names Act. The 2016 legislation represented the most comprehensive reform of Swedish naming law in decades, introducing greater flexibility while maintaining an administrative framework to protect individuals and prevent the misuse of names associated with existing companies, organisations, or notable persons.

Key Provisions

The Act covers first names (förnamn) and surnames (efternamn). For first names, Sweden requires parents to register a given name within three months of birth. Names that could cause offence, names that are clearly unsuitable for a given gender without parental intent, or names that could cause the bearer administrative confusion may be rejected by the Swedish Tax Authority (Skatteverket). For surnames, the Act distinguishes between surnames that already exist in the register and new surnames. It is easier to take a surname already used by a family member than to create an entirely new one.

Modern Context

The 2016 reform abolished the requirement that given names conform to gender norms — parents may now give any name to a child regardless of the name's traditional gender associations, provided it does not otherwise violate the Act. This change reflected Sweden's progressive approach to gender identity in naming. The Act also simplified procedures for changing surnames after marriage, divorce, or adoption, and clarified rules for dual citizens navigating Swedish and foreign naming law simultaneously. Skatteverket maintains an online name inquiry service where parents can verify whether a proposed name is likely to be approved.
